Overview
This website is operated by What Goes Over The Couch ("we", "us", "our"). By visiting this site or placing an order you agree to these Terms of Service, together with our Refund Policy, Shipping Policyand Privacy Policy.
If you do not agree to these terms, please do not use the site.
What we sell
We sell original artwork created by Thomas Fallen III, in two forms: digital download files, and physical prints made to order in a range of materials and sizes. Details of what each product includes — file dimensions, proportions, print sizes and materials — are given on each product page.
How our art is made
Our artwork is created digitally by the artist using a range of tools, including AI image-generation software as part of the process, and is then refined, upscaled and prepared for print by hand. It is not painted, drawn or printed by hand in a physical medium, and we do not describe it as such anywhere on this site.
Orders and pricing
Placing an order is an offer to buy, which we accept when we send your order confirmation. We may refuse or cancel any order, and will refund it in full if we do.
Prices are shown in the currency selected for your region and include shipping on physical prints. We may change prices at any time, but never after you have placed an order. We try to keep the site free of errors; where a price or product description is obviously wrong, we may cancel the affected order and refund it rather than honour a mistake.
Colour and appearance
Every screen renders colour differently, and a printed piece will not be an exact match for what you see on your monitor or phone. Our room mockups show artwork at approximately true scale in a setting, and are illustrations of how a piece looks in a room rather than photographs of the item you will receive. This is normal for printed art and is not a fault. Where a print is visibly wrong against its listing, our Refund Policy applies.
Your licence to use our artwork
All artwork, images, text and design on this site remain the property of Thomas Fallen III and are protected by copyright. Buying from us does not transfer copyright.
When you buy a digital download, you receive a personal, non-exclusive, non-transferable licence to:
- print the file as many times as you like, at any size, for your own home or workplace;
- print it for a gift.
You may not resell, redistribute, share or sublicense the file; sell prints made from it; use it in any commercial product, or as part of any product for sale; claim it as your own work; or upload it to any stock, print-on-demand, AI training or file-sharing service. If you would like to use a piece commercially, email us — we are open to it, and licences can be arranged.
When you buy a print, you own that physical object and may display, gift or resell that individual piece. You do not acquire any right to reproduce the image.
Accounts
You are responsible for keeping your account details secure and for activity under your account.
Third parties
Payments, hosting and checkout are provided by Shopify. Prints are produced and shipped by independent production partners. Digital files are delivered through our own hosted delivery system. Each operates under its own terms, and their use of your information is described in our Privacy Policy.
Limitation of liability
To the extent permitted by law, our liability for any order is limited to the amount you paid for it. Nothing in these terms limits liability for death, personal injury, or fraud, or affects any statutory consumer right you have, including rights in respect of goods that are faulty, damaged or not as described.
Changes
We may update these terms from time to time. The version in force is the one published here when you place your order.
Governing law
These terms are governed by the laws of the State of Texas, United States, without affecting any mandatory consumer protection you are entitled to where you live.
